PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE ENGAGING THE SERVICES OF
PSP CUSTOM GARAGE BUILDERS LTD.
1. ACCEPTANCE OF TERMS
By requesting a quote, entering into a contract, or otherwise engaging the
services of PSP Custom Garage Builders Ltd. ("PSP," "we," "our," or "us"), you
("Client," "you," or "your") agree to be bound by these Terms of Service
("Terms"). If you do not agree to these Terms, do not engage our services.
These Terms constitute a legally binding agreement between you and PSP Custom
Garage Builders Ltd., a company incorporated and operating in the Province of
Saskatchewan, Canada.
2. SERVICES
PSP Custom Garage Builders Ltd. provides custom garage design, construction,
and related services in Saskatchewan. The specific scope of work, materials,
timelines, and pricing applicable to your project will be set out in a separate
written contract or agreement ("Project Agreement") provided to you prior to
commencement of work.
In the event of any conflict between these Terms of Service and a Project
Agreement, the terms of the Project Agreement shall prevail with respect to
the specific project.
3. QUOTES AND ESTIMATES
All quotes and estimates provided by PSP are valid for thirty (30) days from
the date of issue unless otherwise stated in writing. Quotes are based on
information available at the time of preparation. Changes to project scope,
site conditions, material availability, or applicable regulations may result
in adjusted pricing. PSP reserves the right to revise a quote if material
inaccuracies in the provided information are discovered.
4. CONTRACTS AND PROJECT AGREEMENTS
No work will commence until a written Project Agreement has been signed by
both parties and any required deposit has been received. Project Agreements
will outline the scope of work, payment schedule, project timeline, warranty
information, and any applicable special terms.
5. PAYMENT TERMS
Payment terms are as specified in the Project Agreement. Unless otherwise
agreed in writing:
(a) A deposit is required prior to commencement of work, the amount of
which will be specified in the Project Agreement;
(b) Progress payments may be required at stages specified in the Project
Agreement;
(c) Final payment is due upon substantial completion of the project;
(d) Overdue balances may be subject to interest charges at a rate of 2%
per month (24% per annum), compounded monthly.
Failure to make timely payments may result in suspension of work without
liability to PSP.
6. CHANGES AND VARIATIONS
Any changes to the agreed scope of work must be requested in writing and
approved by PSP. PSP will provide a written change order outlining the impact
on cost and timeline before proceeding. Work on changes will not commence
until the change order is signed and, where applicable, an additional deposit
is received.
7. CLIENT RESPONSIBILITIES
You agree to:
(a) Provide accurate information regarding the project site, intended use,
and any relevant existing structures;
(b) Obtain and maintain any required permits, approvals, or authorizations
from applicable municipal or provincial authorities, unless PSP has
expressly agreed in writing to obtain such permits on your behalf;
(c) Ensure PSP and its subcontractors have safe, unobstructed access to the
project site during agreed working hours;
(d) Notify PSP promptly of any site conditions that may affect the work,
including underground utilities, environmental concerns, or structural
issues;
(e) Ensure that the project site complies with all applicable zoning bylaws
and land use regulations.
8. PERMITS AND REGULATORY COMPLIANCE
PSP will construct all garages in accordance with applicable Saskatchewan
building codes and regulations. Unless explicitly agreed otherwise in writing,
responsibility for obtaining building permits and complying with local
municipal requirements rests with the Client. PSP is not responsible for
project delays or cost increases resulting from permitting delays or
regulatory changes outside of PSP's control.
9. SUBCONTRACTORS
PSP may engage qualified subcontractors to perform portions of the work. PSP
remains responsible for ensuring that subcontracted work meets the standards
set out in the Project Agreement.
10. WARRANTY
PSP warrants its workmanship against defects for a period as specified in the
Project Agreement. This warranty does not cover:
(a) Damage caused by misuse, neglect, or failure to maintain;
(b) Normal wear and tear;
(c) Damage caused by third parties or Acts of God;
(d) Manufacturer defects in materials (which are subject to the applicable
manufacturer's warranty).
Warranty claims must be submitted in writing to [email protected]
within the applicable warranty period.
11. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable Saskatchewan and Canadian law,
PSP's total liability for any claim arising out of or relating to the services
shall not exceed the total amount paid by you to PSP under the applicable
Project Agreement.
PSP shall not be liable for indirect, incidental, consequential, special, or
punitive damages, including but not limited to loss of use, loss of profits,
or loss of business opportunity, even if PSP has been advised of the
possibility of such damages.
Nothing in these Terms limits or excludes liability that cannot be limited or
excluded under applicable law, including the Consumer Protection and Business
Practices Act (Saskatchewan) or other applicable consumer protection
legislation.
12. FORCE MAJEURE
PSP shall not be in breach of these Terms or a Project Agreement, nor liable
for any delay or failure to perform its obligations, where such delay or
failure results from events beyond PSP's reasonable control, including but not
limited to acts of God, extreme weather, labour disputes, material shortages,
supply chain disruptions, government orders, or other circumstances beyond
PSP's control.
13. DISPUTE RESOLUTION
In the event of a dispute arising from these Terms or a Project Agreement,
the parties agree to first attempt resolution through good-faith negotiation.
If negotiation fails within thirty (30) days, either party may pursue
resolution through mediation or, if necessary, through the courts of
Saskatchewan. These Terms shall be governed by and construed in accordance
with the laws of the Province of Saskatchewan and the federal laws of Canada
applicable therein.
14. AMENDMENTS
PSP reserves the right to update these Terms of Service at any time. Updated
Terms will be posted on our website. Continued engagement of our services
following notice of any changes constitutes acceptance of the revised Terms.
